1 GENERAL PROVISIONS
1.1 These regulations define the principles, conditions and scope of use of the „Support in Gdańsk” mobile application intended for mobile devices with Android and iOS operating systems (hereinafter referred to as the „Application”) and constitute regulations within the meaning of Art. 8 of the Act of 18 July 2002 on the provision of services by electronic means.
1.2 The owner and operator of the Application, as well as the service provider of services provided through it, is the Aleksandra FOSA Social Support Foundation with its registered office in Gdańsk at ul. Fryderyka Chopina 42, 80-268, KRS: 0000298471, hereinafter referred to as the „Operator”.
1.3 The User of the Application within the meaning of the Regulations is a natural person who, through the Application installed on their own mobile device, uses the functionalities offered by the Application, hereinafter referred to as the „User”.
1.4 Services provided via the Application:
1.4.1 „Search Support” – Institution search engine. Support institution search engine, the task of which is to enable the User to independently search for support offers in Gdańsk in the area of mental health, equal treatment and addictions. The option is available to both unregistered and registered people.
1.4.2 New messages. The module allows you to read new messages regarding support for people with mental disorders and support for people experiencing discrimination and addictions.
1.4.3 Booking a consultation. This functionality allows you to book a meeting with a consultant from the Information and Consultation Point and the Gdańsk Centre for Equal Treatment via the application. You must also provide a telephone number for the consultant to contact you. The booking is approved by the application operator.
1.4.4 Support the FOSA Foundation – This functionality displays information about the possibility of donating 1.5% to the Public Benefit Organization FOSA Foundation.
Information and Consultation Point : Trainings. Functionality that provides the possibility of using 7-day trainings, training selected psychological/social skills available in the application in the area of mental health.
Information and Consultation Point : Connection with a consultant. The functionality enables telephone contact with a consultant by launching the default application for making telephone calls.
Information and Consultation Point : Check yourself – This functionality enables verification of the addiction problem by giving up the substance or behavior for a planned period.
Information and Consultation Point : „Tests”. This functionality allows you to conduct addiction tests to assess the problem.
Information and Consultation Point : About PIK. This functionality allows the User to familiarize themselves with the project’s activities.
1.4.10 Gdańsk Centre for Equal Treatment: Report unequal treatment. The User has the option to send an initial report regarding a violation of equal treatment via e-mail.
1.4.11 Gdańsk Center for Equal Treatment: Connection with a consultant. The functionality enables telephone contact with a consultant by launching the default application for making telephone calls.
1.4.12 Gdańsk Centre for Equal Treatment: Frequently Asked Questions. This functionality allows you to familiarize yourself with the most frequently asked questions directed to the GCRT.
1.4.13 Gdańsk Centre for Equal Treatment: Quiz. This functionality allows you to perform tasks to assess your awareness of equal treatment and non-discriminatory behaviours and attitudes.
1.4.14 Gdańsk Centre for Equal Treatment: About GCRT. This functionality allows the User to become familiar with the project’s activities.
1.5 The application can be downloaded from the online store: Google Play and iStore
1.6 Before using the Application, the User/Registered User is obliged to read the Regulations and the Privacy Policy and accept them.
1.7 During the registration process, the User, included in the registration form available in the Application, consents to the processing of personal data by the Operator in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation (hereinafter also referred to as GDPR).
1.8 Downloading the Application from the store indicated in point 1.5 of the Regulations, as well as using the basic services offered through it, is free of charge.
1.9 The costs of data transmission required to download, install, run and use the Application are covered by its Users on their own, based on agreements concluded with telecommunications operators or other Internet service providers.
1.10 The Application is the subject of exclusive rights of the Operator and its partners and is subject to legal protection.
1.11 The User is responsible for providing false personal data.


2. TECHNICAL REQUIREMENTS AND RULES OF ACCESS TO THE APPLICATION
2.1 The Application is available to all persons using mobile devices that meet the technical requirements and on which such persons download the Application from the appropriate application store and run it correctly.
2.2 The User’s mobile device on which the Application is to be launched should meet the technical requirements for the operating system described in the store appropriate for the given operating system.
2.3 In order to launch and properly operate the Application, it is necessary to activate the internet connection function by the mobile network operator or Wi-Fi.
2.4 In order to use the full functionality of the Application, the User is obliged to register via the Application.


3 USER REGISTRATION
3.1 When using the application, in order to launch the full functionality of the application, the User should go through the registration process in the Application, which consists in setting up an individual User account, hereinafter referred to as „Registration”.
3.2 To complete the Registration, the User must provide:
3.2.1 email address;
3.2.2 password;
3.2.3 repeated password;
3.2.4 confirmation by the User that he/she has read the Regulations and accepts their content.
3.3 After registration, a registration confirmation message will be sent to the e-mail address provided by the User during Registration.
3.4 Launching and logging in to the Application (or having the Application running in the background) is necessary to use the Device and the functionality of the Application.
3.5 The User has the right to delete his/her data provided during Registration and to change the password set during Registration. Data editing, deletion and password change is possible via the Application.
3.6 During Registration, as well as in connection with the use of the Application, the User is obliged to keep the password for logging in to the Application secret and not to disclose it to other persons.
3.7 The User is solely responsible for disclosing his/her Application login password to third parties.
3.8 The Operator informs that it does not verify the identity of Users during their Registration.


 
4 RULES FOR USING THE APPLICATION
4.1 Users are obliged to use the Application in a manner consistent with applicable law, the Regulations and the regulations of the “Play” and “ iStore ” stores, as well as with the principles of social coexistence, including the general principles of using the Internet and mobile applications.
4.2 Users are obliged to use the Application and the Device in a non-intrusive manner, respecting the personal rights of third parties and any other rights to which they are entitled;
4.3 Users are obliged to notify the Operator of any case of violation of their rights in connection with the use of the Application.


5 OPERATOR’S RESPONSIBILITY
5.1 The Operator conducts ongoing supervision over the technical functioning of the Application and ensures its correct operation.
5.2 The User is obliged to ensure the correct functioning of the Application to the extent that it depends on the User. The actions of services other than the Application are the responsibility of their operators and suppliers.

6. TERMINATION OF USE OF THE APPLICATION AND DELETION OF DATA
6.1 Users may stop using the Application at any time. In particular, if they do not accept the changes introduced in the Regulations. Stopping using the Application requires only deleting it from the mobile device. Deleting the Application from the mobile device is not equivalent to deleting the User’s account.
6.2 In order to delete personal data, the User may use the option available in the Application in the „user profile” panel „Delete data”, which will result in deleting the data;
In any case, the User may send a request to delete personal data to the e-mail address: application@fundacjafosa.pl.
6.3 If it is found that the User is committing actions prohibited by law, the Regulations, violating the principles of social coexistence, or harming the good name of the Operator, the Operator may take any actions permitted by law against the User.


7 PRIVACY AND CONFIDENTIALITY
7.1 The administrator of personal data is the Operator – Fundacja Oparcia Społecznego Aleksandry FOSA. Detailed information about the Administrator, the Data Protection Officer and the principles of protection of personal data of Application Users are included in the Privacy Protection Principles.


8 COMPLAINTS
8.1 Complaints related to the use of the Application and difficulties in providing services via it, as well as questions should be sent to the Operator at the e-mail address: application@fundacjafosa.pl.
8.2 The complaint should include: first name, last name, telephone number, e-mail address, information about the current version of the IT system installed on the mobile device and a description of the complaint.
8.3 Within 14 days from the date of receipt of the complaint, the Operator will consider the complaint and inform the User, via e-mail, about the method of its consideration. The time for providing additional explanations by the user at the request of the operator extends the period for considering the complaint


9 FINAL PROVISIONS
9.1 In situations not regulated in the Regulations, the provisions of generally applicable law shall apply, with particular emphasis on the Civil Code and the Act on the provision of services by electronic means.
9.2 Any disputes concerning or arising from the use of the Services by the User shall be resolved by the court having jurisdiction over the registered office of the Operator.
9.3 The Regulations are available via the Application and on the website related to the Application – www.wsparciewgdansku.pl.
9.4 The Operator reserves the right to change the Regulations at any time. Users will be informed about changes to the Regulations when they first start the Application after the changes to the Regulations. Changes to the Regulations are considered accepted by the User at the moment of his/her further use of the Application after the changes come into effect.
9.5 The Regulations enter into force on 1 December 2020 and were updated on 23 December 2024 .
